Are you evaluating an employee based on his or her current state?

Does the employee?

• appear intoxicated?

• behave as if intoxicated?

• have slurred speech?

• have an odor on the body, clothing or breath suggesting recent alcohol use?

Is the employee being evaluated?

• by a supervisor who has undergone specified training to identify drug or alcohol use?

• based on specific, contemporaneous observations?

Has a second supervisor agreed that testing for reasonable suspicion should be done?
