Description

Drug testing of an employee can be performed if there is reasonable suspicion of the employee being under the influence of drugs or alcohol.

Basis for suspicion - one or more of the following:

(1) appearance

(2) behavior

(3) speech (slurring of words, other)

(4) body, clothing or breath odor (especially for alcohol)

An assessment must be performed:

(1) by a supervisor who has undergone specified training.

(2) based on specific, contemporaneous observations that can be articulated

The decision to perform drug and/or alcohol testing requires consensus of two supervisors. One of these should be the trained supervisor who conducted the assessment.
