Description

An employer must ensure that a workplace is safe for the workers. Misconduct of a worker may endanger the safety at work.


Misconduct occurs when a worker breaks the rules. Misconduct may be preventable or unpreventable.

 

The misconduct is considered unpreventable if:

(1) The company has rules designed to prevent safety violations.

(2) The rules are appropriate and reasonable.

(3) Employees are introduced and adequately trained about the rules.

(4) Steps are taken to identify violations (rules are policed).

(5) Rules are effectively enforced when a violation occurs.

 

Effective enforcement:

(1) follows the company's policies

(2) often is progressive in the severity of the response to repeated violations

(3) is consistent for all employees
