Description

The results of HIV antibody testing are held confidential in most states and can only be given out in certain specified situations. The situations listed below are those given in the Ohio State Public Health laws. The patient has the right to ask the testing facility if HIV-related information has been released to anyone.


 

Persons to whom HIV antibody test results may be released in Ohio (USA):

(1) to the patient

(2) to the patient's legal guardian

(3) to the patient's spouse or sexual partner

(4) to a person authorized by the patient or the patient's legal guardian in written release

(5) to the patient's physician

(6) to the Department of Health or a health commissioner

(7) to agencies involved in screening your donated body parts

(8) health care facility groups conducting program evaluations or reviews (staff committees, accreditation, oversight review organizations)

(9) to law enforcement authorities with a search warrant or subpoena in connection with a criminal investigation or prosecution

(10) to health care providers, emergency medical services worker or peace officer who sustained a significant exposure to body fluids from the individual.

 

Limitations:

• How a sexual partner is to confirm the relationship is not specified.

• A subpoena can be easily obtained and some facilities require a court order for release of the information.
