Intoxication has a variety of meanings depending on the situation. Meeting the legal definition of intoxication has a number of implications related to an injury or accident.
Criteria for intoxication - both of the following:
(1) not having normal use of mental and/or physical faculties (impairment)
(2) due to a voluntary introduction of one or more of the following:
(2a) alcohol
(2b) a controlled substance
(2c) a dangerous drug
(2d) abusable glue or aerosol pain
(2e) any other similar substance regulated under state law
Exclusions:
(1) involuntary introduction
(2) use in accordance with a prescription written by a physician
(3) inhalation or absorption of a substance incidental to the person's work
Intoxication with alcohol alone involves a level in blood, urine or breath above the legal limit. Intoxication may occur with alcohol at a lower level if mixed with another substance.
