Description

A Medical Review Officer (MRO) may change a verified result for a drug test done on a person operating under Department of Transportation (DOT) regulations.


 

A verified drug test result is one which has been determined to be positive for a drug of abuse, negative, cancelled or refusal to test because of adulteration or substitution (DOT 40.129). This is done by the MRO after reaching or attempting to reach the donor/employee (testee) for an interview to determine if there is a legitimate medical explanation for the drug test results.

 

A verification may be reopened and changed if:

(1) The original verification was performed without talking to the donor/employee.

(2) The laboratory notifies the MRO that an error occurred (in the paperwork, testing, etc.)

(3) Additional information not previously available is made available within 60 days of the verification which explains the presence of a drug, drug metabolite, adulterant or substitution.

(4) Additional information not previously available is made available after 60 days of the verification if done with the approval of the DOT ODAPC (Office of Drug and Alcohol Policy and Compliance).

(5) The MRO made an administrative error.

 

A verified result may not be changed under any other circumstances.

 

If a verified result is changed, then the designated employee representative (DER) must be notified in writing.
