Actions which are considered refusals:
(1) as an employee failure to appear for testing within a reasonable period of time
(2) as an employee leaving the testing site before the testing process commences
(3) as an employee failure to remain at the testing site until the testing process is complete
(4) failure to produce a urine specimen within 3 hours, unless found to have a medical condition making submission impossible
(5) failure to undergo a medical examination within the stipulated time when unable to produce a urine specimen within 3 hours
(6) if a directly observed or monitored collection, failure to permit the observation or monitoring
(7) failure to take a second test the employer or collector has directed you to take
(8) failure to cooperate in any part of the testing process, including disruptive behavior or failure to empty pockets
(9) submission of an adulterated or substituted specimen for testing
Actions which are not considered refusals:
(1) as an employee, refusal to take a non-DOT required test or sign a non-DOT form
(2) declining to drink fluids when unable to produce a urine specimen
(3) if pre-employment, failure to appear for a test
(4) if pre-employment, leaving the testing site before the testing processes commences
(5) failure to produce a urine specimen within 3 hours when found on medical examination to have a condition that prevents specimen production
